28th July

Completed 50 minute brisk walk. Spent the day reading newspapers, magazines and watching Olympics on DD Sports. Kashyap was playing well and leading against Tan of Belgium in the Badminton match. Could not see it more as i had fear of losing by Kashyap. It is the fear of losing by India which comes in the way  of my watching any event. I would not leave watching a match where India is likely to win. But all this is in not in good  taste. In fact i should rather watch the beauty of a game than loss or gain to a country. If i cannot detach myself from loss or gain, i will ever miss the beauty of life in its various manifestations.  Games and sports are such a manifestation.

The following lines struck me about Late Rajesh Khanna :
1."Rajesh Khanna seemed to be like a monument into which Jatin Khanna walked nondescriptly. Truly, as Jatin Khanna said, Rajesh Khanna is a shadow; he lives nowhere. He is actually no one.. He is an invitation for such souls to fly out, to float out, and to experience the openness of space and the lightness of air. This openness was his appeal; this lightness, his illumination.Sushmita Das, ET,dt.26th, July,2012

News of the day :1."The world's most accurate atomic clock has clearly proved the nearly 100-year-old  theory by Albert Einstein that time is a relative concept and the higher you live above sea level the faster you should age. Einstein's theory of relativity states that time and space are not as constant as everyday life would suggest. "Punjab-born centenarian Fauja Singh, who defies age to run marathons, drew the loudest cheers on Saturday, as the Olympic Torch was carried by him, Olympic medal winners, and leading individuals through London, amidst a welcome, clear sky and sunshine.
Clad in all-white apparel and a matching white turban, the sprightly Singh carried the torch, accompanied by hundreds of admirers, including Sikhs with yellow t-shirts bearing Singh’s image, who hailed him every moment of the distance he travelled.

In the above context, the change in the administration of justice is likely to be slow. Ethics in public life is missing. The politician is interested in remaining in power. The bureaucrat is also similarly poised. Only a small section thinks for the common man. There are few like Justice SB Sinha who are doing pioneering work in the field of ADRs. ( Alternative dispute disposal resolutions ). Let us not lose hope. I can write to you with confidence that things are much better now than what they were a decade back. It has been possible due to a proactive judiciary, media and general awareness of the people."

14th July

Could go for 55 minute walk in the evening.
Attended a conference of National Bar Association of India at IIC from 10 am to 3.15pm with lunch and tea breaks. The Conference dealt with Alternative Dispute Disposal Resolutions (ADRr). It was an informative discussion on advantages of Alternative Dispute Disposal Resolutions in Indian legal system. Particularly, the address of Justice SB Sinha was illuminating. He said that litigation is very expensive. Only 9%  could afford to go to the courts for the dispute resolutions;  50% leave the matters and put up with the loss/ignominy; 30% go to police/politicians and remaining try through goondas/mastans, even via Dubai. In this unhappy scenario, ADRs become quite relevant. The ADRs in Govt. sector, in Armed forces and Corporate sector were discussed. The addresses on the use of technology in providing speedy justice by Himanshu Goswami and International Arbitration by Anand Dayal respectively were eye openers. I was Assocham invitee to the conference.

"Scientists are using the world's biggest telescope , buried deep under the South Pole, to try to unravel the mysteries of tiny particles known as neutrinos, hoping to shed light on how the universe was made.

The mega-detector , called IceCube, took 10 years to build 2,400 metres below the Antarctic ice. At one cubic km, it is bigger than the Empire State building, the Chicago Sears Tower - now known as Willis Tower - and Shanghai's World Financial Center combined.

Designed to observe neutrinos , which are emitted by exploding stars and move close to the speed of light, the telescope is attracting new attention in the wake of last week's discovery of a particle that appears to be the Higgs boson

"Justice Iyer of the Supreme Court made a distinction between the 'rule of law' and the 'rule of life' in a judgement in 1975. The judge articulated the ever present tension between a universal 'rule of law' and an insular 'rule of life'at the heart of India's democracy. The human DNA is imprinted with a natural propensity to favour family, friends and community. These loyalties invite corruption and nepotism in the absence of strong incentives in favour of impartiality. The social anthropologist, Earnest Gellner, labelled it 'tyranny of cousins'. The historian David Gilmartin equates the 'rule of li.fe' to sva-dharma, duties to one's family, cast and community. In contrast, the rule of law is akin to sadharana dharma, duties which reflect the higher universal ideals of the Constitution." Gurcharan Das in TOI at p.,10,dt.08.o7.12 A brilliant analysis of the state of affairs in the society by Shri Das.

Could  go for 50 minute brisk walk in the evening. Had to leave for a conference on"Law and Economics", organised by Assocham in Meridian hotel at about 9:00 a.m. The conference continued from 10:00 a.m.- 4:15 p.m. with breaks for Tea and Lunch. Shri Salman Khurshid, Union Law Minister of India was the Chief Guest. The sanctity of the contract was discussed besides other issues connected with administration of Justice, Governance, Taxation Laws etc. It was a very informative conference. I refreshed my knowledge of law as I studied law of Contract in LL.B and LL.M from 1958-62 and as lawyer for the last about 15 years. The law I studied, the law as i enforced as a police officer and the law as i practice now are so different. There are wide gaps between the knowledge, enforcement and practice of law. We can bridge the gap by  ethics in practice of law, a difficult proposition.

This week I received a beautiful letter from my eldest grand daughter,10 year old Khyati. There are a number of stickers on it. These have pictures of scorpion, stars ,flowers, leaves, sun, toys. It also has a pastel /water color (could not be sure) painting ( already painted a good number. Given me one which i have kept in my bedroom) of Singapore, where she went for a holiday for a few days along with her parents in May.2012. In the letter she has profusely thanked me for getting passport to her on her ninth birthday. I quote some of the lines from the letter which touched my heart  Regarding getting passport she writes,"Then a very kind man called DNS Shrivastava stepped in and got my passport"............"I thank you IX 20000 times for getting me passport".Gratefulness is spiritual. She is a little girl and she is spiritual. She has inherited this from her ancestors who are and were deeply spiritual. Spirituality is self realization. You are face to face with love and kindness. You feel grateful to all who love and are kind.
About Singapore she writes,"When we landed at Singapore, I could hardly believe my eyes. Singapore is so different. Not even a speck of dust and seems like a picture. It was so nice to be in a country where everything is organised. The main highlight of this trip was our visit to Sentosa (She has put a sticker, which shows an image of Sentosa). We went by cable car and visited under water world and Unversal studios. We saw a dolphin show. The dolphins performed tricks. .........At universal studios we went on some rides and saw how special effects are done in Movies"
